Terms of Service

1. Agreement

By accessing getpackprofit.com, joining our Discord server, or purchasing a subscription (e.g. via Whop or another payment provider), you agree to these Terms. If you do not agree, do not use the service.

2. The service

Pack Profit provides informational alerts (primarily via Discord, optionally SMS on higher tiers) about Pokémon TCG sealed product restocks and potential arbitrage opportunities at certain US retailers, which may include estimated profit-after-fees calculations. Features and retailers may change. Founder pricing is limited and may end at any time.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. The service is intended for users in the United States unless we state otherwise.

4. Accounts and Discord

Access may require a Discord account and membership roles managed by us and/or a third party (e.g. Whop). You are responsible for securing your accounts. We may suspend or remove access for abuse, chargebacks, scraping our systems, harassing members, or violating Discord’s or our rules.

5. Subscriptions, trials, and refunds

Paid plans (Free / Pro / Pro+SMS / founder pricing if offered) are described at purchase time. Billing is handled by the payment provider (e.g. Whop). Refunds: follow the payment provider’s policy unless we publish a more specific refund policy. Cancel anytime to stop future renewals; you generally keep access through the paid period already charged. Founder “locked” rates, if offered, apply only while your subscription remains continuous as described at signup.

6. Acceptable use

You may not: (a) resell or publicly redistribute our raw alert feed without permission; (b) attack, overload, or reverse engineer our monitors beyond ordinary use; (c) use alerts to violate retailer terms, purchase limits, or applicable law; (d) impersonate Pack Profit or claim affiliation with Pokémon / Nintendo / retailers; (e) post illegal content in our communities.

7. Intellectual property

Pack Profit branding, site design, alert formatting, and original content are owned by us. Third-party trademarks (Pokémon, retailer names, etc.) remain their owners’ property and appear for identification only.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS.” SEE THE PRODUCT DISCLAIMER. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant uninterrupted alerts, accurate prices, successful purchases, or profits.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACK PROFIT AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFITS DAMAGES, OR FOR AMOUNTS EXCEEDING THE FEES YOU PAID US IN THE THREE (3) MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the minimum allowed.

10. Indemnity

You will indemnify and hold us harmless from claims arising from your use of alerts, your purchases/resales, or your violation of these Terms or third-party rights.

11. Third-party services

Discord, Whop, Stripe, Twilio, retailers, and data providers are third parties with their own terms. We are not responsible for their outages or decisions (including account bans).

12. Changes

We may update these Terms by posting a new version. Material changes for paying members should be announced in Discord or email with reasonable notice where practicable. Continued use after the effective date constitutes acceptance.

13. Termination

You may stop using the service anytime. We may terminate or suspend access for breach or risk to the service. Sections that should survive (IP, disclaimers, liability, indemnity) survive termination.

14. Governing law

These Terms are governed by the laws of the United States and the U.S. state in which Pack Profit's operator is located, without regard to conflict-of-laws rules. Nothing here limits rights you have under applicable consumer-protection law.
